TERMS & CONDITIONS

These Terms govern your purchase from Its Me by HZ, LLC, doing business as LushedUp Finance (“LushedUp Finance,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. ACCEPTANCE OF TERMS

By registering for, accessing, or using any LushedUp Finance program, webinar, or service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any other policies posted on our website.

We reserve the right to modify these Terms at any time. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

2. ELIGIBILITY

You must be at least 18 years of age to use our Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. DESCRIPTION OF SERVICES

LushedUp Finance provides educational programs, courses, webinars, and resources related to personal finance, halal investing, and financial literacy (the "Program").

3.1 Nature of Services

Our Services are educational in nature and are designed to provide general information and strategies. The Services do NOT constitute:

  • Financial advice
  • Investment advice
  • Tax advice
  • Legal advice
  • Religious rulings (fatwas)

3.2 No Financial Advisory Relationship

LushedUp Finance and its founder, Hamna Zaheer, are NOT registered investment advisors, financial planners, brokers, or certified public accountants. We do not provide personalized financial advice, and no advisor-client relationship is created by your use of our Services.

You are solely responsible for your own financial decisions. You should consult with a qualified financial advisor, tax professional, and/or Islamic scholar before making any investment or financial decisions.

4. PROGRAM ACCESS & ENROLLMENT

4.1 Enrollment

When you enroll in a LushedUp Finance program:

  • You will receive login credentials to access the program materials via our learning platform (currently Kajabi)
  • You will gain access to the modules, live coaching calls, private community, and any bonuses as outlined in your purchase
  • Access is granted for the duration specified at the time of purchase (typically lifetime access unless otherwise stated)

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Not share your login credentials with others
  • Not allow unauthorized access to your account
  • Notify us immediately of any unauthorized use of your account

4.3 Prohibited Use

You may NOT:

  • Share, reproduce, distribute, or resell any part of the Program materials
  • Record, screenshot, or copy Program content for distribution
  • Use the Program for any unlawful purpose
  • Violate intellectual property rights

5. PAYMENT TERMS

5.1 Pricing

All prices are stated in U.S. Dollars (USD) and are subject to change. The price you pay is the price displayed at the time of purchase.

5.2 Payment Methods

We accept payment via credit card, debit card, and other payment methods as displayed at checkout. Payment processing is handled by third-party processors (e.g., Stripe, PayPal, Kajabi Payments).

5.3 Payment Plans

If you choose a payment plan option:

  • You authorize us to charge your payment method automatically on the scheduled dates
  • Failure to make timely payments may result in suspension of access until payment is received
  • Payment plan totals may be higher than the pay-in-full option
  • If any payment plan installment is not successfully processed within seven (7) days of the initial charge attempt, the student will be removed from the program without further notice.

5.4 Taxes

You are responsible for any applicable sales tax, VAT, or other taxes based on your location.

6. REFUND POLICY

6.1 60-Day Implementation Guarantee

LushedUp Finance offers a conditional 60-Day Implementation Guarantee for the Halal Wealth Autopilot Academy.
This guarantee is designed for students who genuinely participate in the Program, complete the required work, implement the strategies taught, and, after doing so, still do not have a clear financial path forward.
This is not a no-questions-asked refund policy, free trial, cancellation period, satisfaction guarantee, or opportunity to reserve a spot while deciding whether to participate.
To qualify for a refund under the 60-Day Implementation Guarantee, you must satisfy all of the following requirements:
  • Remain actively enrolled in the Program for at least 55 days from your date of purchase.
  • Complete all Program modules released or assigned through Day 55, including the corresponding worksheets, exercises, and implementation activities.
  • Attend live or watch the full replay of every coaching call made available during your first 55 days in the Program.
  • Actively implement the strategies taught in the Program as they apply to your financial situation. Simply watching or consuming the content without completing the implementation work does not satisfy this requirement.
  • Provide reasonable evidence of your participation and implementation. Evidence may include completed worksheets, budgets, financial goals, financial plans, portfolio exercises, questions submitted for coaching, community participation, or other assigned Program work.
  • Submit your written refund request between Day 55 and Day 60 following your date of purchase.
Refund requests submitted before Day 55 or after Day 60 are not eligible under the 60-Day Implementation Guarantee.
Simply remaining enrolled for 55 or 60 days does not qualify you for a refund. Eligibility is based on completing and implementing the requirements above.

6.2 Circumstances Not Covered by the Guarantee

The following circumstances do not qualify for a refund under the 60-Day Implementation Guarantee:
  • Changing your mind after enrolling
  • Deciding that the Program is no longer the right fit before completing the required implementation
  • Lack of time or competing personal or professional commitments
  • Travel, scheduling conflicts, falling behind, or inability to attend live
  • Failure to access or complete Program materials
  • Failure to attend or watch required coaching calls
  • Failure to complete required worksheets, exercises, or implementation activities
  • Personal, family, employment, or financial circumstances that prevent you from continuing
  • Enrolling in order to reserve a spot while deciding whether to participate
  • Failure to check your email, spam folder, community platform, or other communication channels after access has been provided
  • Failure to use the tools or strategies taught
  • Violation of these Terms
  • Misconduct, abusive behavior, harassment, fraud, or other conduct resulting in termination of Program access
  • Unauthorized copying, distribution, sharing, resale, or misuse of Program materials
Nothing in this Refund Policy limits any rights that cannot legally be waived under applicable law.

6.3 How to Request a Refund

To request a refund under the 60-Day Implementation Guarantee, you must submit your request in writing to: hamna@lushedup.com
Your request must be received between Day 55 and Day 60 following your purchase date and must include:
  • Your full name
  • The email address used to enroll
  • Confirmation that you completed the required Program modules and implementation work
  • Evidence showing completion and implementation of the Program requirements
  • Confirmation that you attended or watched the replay of all coaching calls made available through Day 55
  • A brief explanation of what you implemented and why, after completing the Program requirements, you believe you still do not have a clear financial path forward
LushedUp Finance may review Program activity, submitted assignments, coaching attendance or replay access, community participation, submitted questions, and other relevant information when evaluating whether the requirements of the guarantee have been satisfied.
Meeting the timing requirement alone does not qualify you for a refund.

6.4 Approved Refunds

If your refund request is approved:
  • Your refund will be issued to the original payment method
  • Refund processing will generally begin within 7 to 10 business days after approval
  • Your access to the Halal Wealth Autopilot Academy will be revoked
  • Your access to the Skool community, coaching, Program materials, resources, and bonuses will be revoked
  • Any remaining scheduled payments under an approved payment plan will be canceled
Bank or card-provider processing times may vary after the refund has been issued.

6.5 Payment Plans

Choosing a payment plan does not create a month-to-month membership or give you the ability to cancel future payments at any time.
By enrolling through a payment plan, you are committing to the full purchase price of the Program, paid according to the installment schedule selected at checkout.
Students enrolled through a payment plan remain responsible for all scheduled payments unless:
  • A refund is approved under the 60-Day Implementation Guarantee; or
  • LushedUp Finance agrees otherwise in writing.
If a refund is approved under the guarantee, eligible payments already made will be refunded and any remaining scheduled installment payments will be canceled.

6.6 Bonuses

Bonuses offered as part of enrollment, including but not limited to:
  • Fast-action bonuses
  • Bonus modules
  • Generational Wealth content
  • Personalized Wealth Plan reviews
  • Written feedback
  • One-on-one coaching sessions
  • Limited-time resources
are provided as part of the overall Program enrollment and do not create a separate refund right.
If a refund is approved, access to any unused bonuses will terminate immediately.

Completed one-on-one coaching sessions, completed personalized reviews, or other services already delivered are not independently refundable.

 

6.7 One-on-One Coaching and Personalized Feedback Bonus Policy


 Students who receive a complimentary one-on-one coaching session and/or personalized financial plan feedback from Hamna as part of a promotional offer or enrollment bonus must comply with the following conditions:

 
a. Completion Requirements
 
Before scheduling a one-on-one coaching session or requesting personalized feedback, students must complete and submit the following Academy assignments:
  • Master Budget Tracker
  • Net Worth Tracker
  • Portfolio Builder
All three assignments must be completed and submitted before the bonus can be redeemed.
 
b. Four-Month Redemption Deadline
 
All one-on-one coaching sessions and personalized feedback bonuses must be fully utilized within four (4) calendar months of the original enrollment purchase date.
 
This deadline applies regardless of the student's progress through the Academy, participation in coaching calls, or completion of required assignments.
 
Students are responsible for completing their assignments and scheduling their sessions sufficiently in advance of the deadline.
 
c. Expiration of Unused Bonuses
 
Any one-on-one coaching session or personalized feedback bonus not redeemed within the four-month period will automatically expire.
 
Unused bonuses have no cash value and are not eligible for refunds, credits, transfers, or substitutions.
 
d. Paid Extensions
 
Students who wish to redeem an expired bonus may request a one-time, 30-day extension for an additional, nonrefundable fee of $197.
 
Extensions are subject to Hamna's availability and approval and are not guaranteed. The extension fee must be paid in full before an extension is granted.
 
Payment of the extension fee does not waive the assignment completion requirements.
 
e. Scheduling and Availability
 
Students are responsible for scheduling their coaching sessions within the applicable redemption period. Availability is limited, and students are strongly encouraged to schedule well in advance.
 
Failure to schedule a session before the expiration deadline does not entitle the student to a complimentary extension.
 
f. No Impact on Academy Access
 
Expiration of a promotional bonus does not affect the student's continued access to the Halal Wealth Autopilot Academy, its educational materials, or other benefits included in their enrollment agreement.

 

7. INTELLECTUAL PROPERTY

7.1 Ownership

All content provided through the Services, including but not limited to videos, worksheets, templates, calculators, graphics, text, and trademarks (collectively, "Content"), is the intellectual property of LushedUp Finance and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

Upon enrollment, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for your personal, non-commercial use.

You may NOT:

  • Copy, reproduce, distribute, or create derivative works from the Content
  • Share login credentials or Content with others
  • Use the Content for any commercial purpose
  • Remove any copyright or proprietary notices

7.3 Violation

Violation of intellectual property rights may result in immediate termination of your access and potential legal action.

8. USER-GENERATED CONTENT

If you participate in our private community (e.g., WhatsApp group, discussion forums):

  • You retain ownership of any content you post
  • You grant LushedUp Finance a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content for purposes of operating the community
  • You agree not to post content that is illegal, offensive, defamatory, or violates others' rights
  • We reserve the right to remove any content or ban users who violate community guidelines

By sharing your wins, breakthroughs, or "aha moments" in the LushedUp Finance WhatsApp community or any other LushedUp Finance platform,

  • You grant permission for LushedUp Finance to use this content for marketing, promotional, and educational purposes, including but not limited to website content, social media, and sales materials. Your first name may be used alongside your testimonial. Your full name, contact details, or any other personal information will never be shared without your explicit consent.

9. DISCLAIMERS

9.1 No Guarantees

LushedUp Finance makes NO guarantees or promises regarding financial results. Your success depends on many factors including your effort, discipline, financial situation, risk tolerance, and market conditions—none of which we can control.

9.2 Educational Purpose Only

The Program is for educational and informational purposes only. It is not a substitute for professional financial, tax, or legal advice.

9.3 No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free
  • The information provided will be accurate, complete, or current
  • Any defects will be corrected

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, LUSHEDUP FINANCE, ITS FOUNDER, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits
  • Loss of data
  • Financial losses from investment decisions
  • Business interruption

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PROGRAM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless LushedUp Finance and its founder, Hamna Zaheer, from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your financial or investment decisions

12. TERMINATION

12.1 Termination by You

You may stop using the Services at any time. If you wish to terminate your account, contact us at hamna@lushedup.com.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the Services at any time for any reason, including but not limited to:

  • Violation of these Terms or community guidelines
  • Fraudulent, illegal, or abusive behavior
  • Non-payment
  • Disruptive behavior that negatively impacts the community
  • If we determine, in our sole discretion, that you are not a good fit for the Program

Refund Policy for "Not a Good Fit" Terminations:

If we terminate your access due to a mutual lack of fit (not misconduct), we will provide a prorated refund for unused content or, if within 30 days, may offer a full refund at our discretion. No refund will be provided for terminations due to violations, misconduct, or abuse.

13. GOVERNING LAW & DISPUTE RESOLUTION

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

13.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall be resolved through:

Step 1: Informal Negotiation You agree to first contact us at hamna@lushedup.com to attempt to resolve the dispute informally.

Step 2: Binding Arbitration If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in Virginia (or remotely via video conference).

You agree to waive your right to a jury trial or to participate in a class action lawsuit.

13.3 Exceptions

Notwithstanding the above, either party may seek injunctive relief in court to protect intellectual property rights.

14. MISCELLANEOUS

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Earnings Disclaimer, constitute the entire agreement between you and LushedUp Finance regarding the Services.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, or technical failures.
