These Terms and Conditions ("Terms") govern your access to and use of the LushedUp Finance website, programs, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. ACCEPTANCE OF TERMS

By registering for, accessing, or using any LushedUp Finance program, webinar, or service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any other policies posted on our website.

We reserve the right to modify these Terms at any time. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

2. ELIGIBILITY

You must be at least 18 years of age to use our Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. DESCRIPTION OF SERVICES

LushedUp Finance provides educational programs, courses, webinars, and resources related to personal finance, halal investing, and financial literacy (the "Program").

3.1 Nature of Services

Our Services are educational in nature and are designed to provide general information and strategies. The Services do NOT constitute:

  • Financial advice
  • Investment advice
  • Tax advice
  • Legal advice
  • Religious rulings (fatwas)

3.2 No Financial Advisory Relationship

LushedUp Finance and its founder, Hamna Zaheer, are NOT registered investment advisors, financial planners, brokers, or certified public accountants. We do not provide personalized financial advice, and no advisor-client relationship is created by your use of our Services.

You are solely responsible for your own financial decisions. You should consult with a qualified financial advisor, tax professional, and/or Islamic scholar before making any investment or financial decisions.

4. PROGRAM ACCESS & ENROLLMENT

4.1 Enrollment

When you enroll in a LushedUp Finance program:

  • You will receive login credentials to access the program materials via our learning platform (currently Kajabi)
  • You will gain access to the modules, live coaching calls, private community, and any bonuses as outlined in your purchase
  • Access is granted for the duration specified at the time of purchase (typically lifetime access unless otherwise stated)

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Not share your login credentials with others
  • Not allow unauthorized access to your account
  • Notify us immediately of any unauthorized use of your account

4.3 Prohibited Use

You may NOT:

  • Share, reproduce, distribute, or resell any part of the Program materials
  • Record, screenshot, or copy Program content for distribution
  • Use the Program for any unlawful purpose
  • Violate intellectual property rights

5. PAYMENT TERMS

5.1 Pricing

All prices are stated in U.S. Dollars (USD) and are subject to change. The price you pay is the price displayed at the time of purchase.

5.2 Payment Methods

We accept payment via credit card, debit card, and other payment methods as displayed at checkout. Payment processing is handled by third-party processors (e.g., Stripe, PayPal, Kajabi Payments).

5.3 Payment Plans

If you choose a payment plan option:

  • You authorize us to charge your payment method automatically on the scheduled dates
  • Failure to make timely payments may result in suspension of access until payment is received
  • Payment plan totals may be higher than the pay-in-full option

5.4 Taxes

You are responsible for any applicable sales tax, VAT, or other taxes based on your location.

6. REFUND POLICY

6.1 60-Day Money-Back Guarantee

LushedUp Finance offers a 60-day money-back guarantee from the date of purchase, subject to the following conditions:

To qualify for a refund, you must:

  1. Have completed at least the first 3-4 modules of the Program
  2. Have attended at least one (1) live coaching call (or watched the replay)
  3. Have made a good-faith effort to implement the strategies taught
  4. Submit your refund request in writing to [email protected] within 60 days of purchase
  5. Provide evidence of your participation (e.g., completed worksheets, questions asked in community)

Refunds will NOT be granted if:

  • You have not engaged with the Program content
  • You request a refund after 60 days
  • You have violated these Terms in any way
  • You have downloaded all materials and then requested a refund (digital piracy)
  • You have not engaged with the Program content

  • Your access was terminated by LushedUp Finance due to misconduct, violation of Terms, or abusive behavior

6.2 Refund Process

If your refund request is approved:

  • We will process your refund within 7-10 business days
  • Refunds will be issued to the original payment method
  • Access to the Program will be revoked upon refund

6.3 Payment Plan Refunds

If you enrolled via a payment plan and request a refund:

  • You will receive a refund for payments made, minus any content already accessed
  • Future scheduled payments will be canceled

6.4 No Refunds for Bonuses

Fast-action bonuses, limited-time offers, and any one-on-one coaching sessions already completed are non-refundable.

7. INTELLECTUAL PROPERTY

7.1 Ownership

All content provided through the Services, including but not limited to videos, worksheets, templates, calculators, graphics, text, and trademarks (collectively, "Content"), is the intellectual property of LushedUp Finance and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

Upon enrollment, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for your personal, non-commercial use.

You may NOT:

  • Copy, reproduce, distribute, or create derivative works from the Content
  • Share login credentials or Content with others
  • Use the Content for any commercial purpose
  • Remove any copyright or proprietary notices

7.3 Violation

Violation of intellectual property rights may result in immediate termination of your access and potential legal action.

8. USER-GENERATED CONTENT

If you participate in our private community (e.g., WhatsApp group, discussion forums):

  • You retain ownership of any content you post
  • You grant LushedUp Finance a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content for purposes of operating the community
  • You agree not to post content that is illegal, offensive, defamatory, or violates others' rights
  • We reserve the right to remove any content or ban users who violate community guidelines

9. DISCLAIMERS

9.1 No Guarantees

LushedUp Finance makes NO guarantees or promises regarding financial results. Your success depends on many factors including your effort, discipline, financial situation, risk tolerance, and market conditionsā€”none of which we can control.

9.2 Educational Purpose Only

The Program is for educational and informational purposes only. It is not a substitute for professional financial, tax, or legal advice.

9.3 No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free
  • The information provided will be accurate, complete, or current
  • Any defects will be corrected

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, LUSHEDUP FINANCE, ITS FOUNDER, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits
  • Loss of data
  • Financial losses from investment decisions
  • Business interruption

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PROGRAM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless LushedUp Finance and its founder, Hamna Zaheer, from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your financial or investment decisions

12. TERMINATION

12.1 Termination by You

You may stop using the Services at any time. If you wish to terminate your account, contact us at [email protected].

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the Services at any time for any reason, including but not limited to:

  • Violation of these Terms or community guidelines
  • Fraudulent, illegal, or abusive behavior
  • Non-payment
  • Disruptive behavior that negatively impacts the community
  • If we determine, in our sole discretion, that you are not a good fit for the Program

Refund Policy for "Not a Good Fit" Terminations:

If we terminate your access due to a mutual lack of fit (not misconduct), we will provide a prorated refund for unused content or, if within 30 days, may offer a full refund at our discretion. No refund will be provided for terminations due to violations, misconduct, or abuse.

13. GOVERNING LAW & DISPUTE RESOLUTION

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

13.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall be resolved through:

Step 1: Informal Negotiation You agree to first contact us at [email protected] to attempt to resolve the dispute informally.

Step 2: Binding Arbitration If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in Virginia (or remotely via video conference).

You agree to waive your right to a jury trial or to participate in a class action lawsuit.

13.3 Exceptions

Notwithstanding the above, either party may seek injunctive relief in court to protect intellectual property rights.

14. MISCELLANEOUS

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Earnings Disclaimer, constitute the entire agreement between you and LushedUp Finance regarding the Services.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, or technical failures.
